The Great Fallacy
of Intellectual Property
I have posted to SSRN an updated and greatly expanded manuscript explaining why the classic argument for intellectual property – that creative and innovative activity requires external incentives – is flawed. I've revised the title to "Intellectual Property and the Incentive Fallacy."
The paper incorporates several arguments I made in a series of posts I did here in December.
I'm pleased to say that the article has been accepted to be published by the Florida State University Law Review in 2012. Since the manuscript is subject to further revision, I continue to be grateful for any comments.
